By accessing or using Promptivox ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. The Service is intended solely for users who are 14 years of age or older. We reserve the right to update these terms at any time; continued use of the Service constitutes acceptance of the updated terms.
2. Ownership of AI-Generated Content & Third-Party Terms
You retain full ownership of all prompts you submit and all AI-generated output you receive through the Service. • User-Owned Output: Any prompt generated by Promptivox using your inputs is yours. You may use, copy, modify, publish, or commercialize the output without restriction from us. • No License Grant to Promptivox: We do not claim any intellectual property rights over your inputs or the generated outputs. • Google API Compliance: Promptivox utilizes Google's Gemini AI API. By using our Service, you agree to comply with Google's Generative AI Terms of Service and Prohibited Use Policies. You are solely responsible for ensuring that your content does not violate Google's terms or infringe on the intellectual property rights of others.
3. Disclaimer of Warranties & Service Interruption
• "As-Is" Service: The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no guarantees regarding the continuous availability or reliability of the Service. We reserve the right to modify, suspend, or permanently terminate the Service (or any part thereof) at any time without prior notice. • AI Accuracy: AI-generated content may be inaccurate, incomplete, or unsuitable for specific purposes. We make no warranty that generated prompts will achieve any particular result when used with other AI systems. • No Professional Advice: Nothing generated by the Service constitutes legal, financial, medical, or other professional advice.
4. Limitation of Liability & Indemnification
• Limitation of Liability: To the fullest extent permitted by law, Promptivox and its operators shall not be liable for any indirect, incidental, special, or consequential damages (including data loss or business interruption) arising from your use of the Service, or reliance on AI-generated outputs. • Indemnification: You agree to indemnify, defend, and hold harmless Promptivox and its operators from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.
5. Prohibited Actions
You agree not to use the Service to: • Generate content that is illegal, harmful, threatening, abusive, defamatory, or violates any applicable laws. • Attempt to reverse-engineer, scrape, or extract the underlying AI models or system prompts. • Use automated scripts or bots to make excessive API requests that burden the infrastructure. • Impersonate any person or entity or misrepresent your affiliation. • Upload or transmit viruses, malicious code, or any content designed to disrupt or harm the Service. • Use the Service to generate spam, phishing content, or deceptive material. Violation of these prohibitions may result in immediate termination of your access to the Service.
6. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Seoul, Korea.

2. AI 생성 콘텐츠의 소유권 및 제3자 약관 준수
귀하는 서비스를 통해 제출한 모든 프롬프트와 AI가 생성한 모든 결과물에 대한 완전한 소유권을 보유합니다. • 사용자 소유 결과물: Promptivox가 귀하의 입력을 기반으로 생성한 모든 프롬프트는 귀하의 소유입니다. 당사의 제한 없이 사용, 복사, 수정, 게시 또는 상업적으로 활용하실 수 있습니다. • Promptivox에 대한 라이선스 부여 없음: 당사는 귀하의 입력 또는 생성된 결과물에 대한 어떠한 지식재산권도 주장하지 않습니다. • Google API 준수: Promptivox는 Google Gemini AI API를 사용합니다. 서비스를 이용함으로써 귀하는 Google의 생성형 AI 이용 약관 및 금지된 사용 정책을 준수할 것에 동의합니다. 귀하는 생성하는 콘텐츠가 Google의 정책을 위반하거나 타인의 지식재산권을 침해하지 않도록 할 책임을 전적으로 집니다.
3. 보증 부인 및 서비스 중단
• "있는 그대로"의 서비스 제공: 서비스는 "있는 그대로(AS IS)" 그리고 "이용 가능한 상태(AS AVAILABLE)"로 제공됩니다. 당사는 서비스의 지속적인 가용성이나 신뢰성을 보증하지 않습니다. 당사는 사전 통지 없이 언제든 서비스(또는 일부)를 수정, 일시 중단 또는 영구 종료할 권리가 있습니다. • AI 정확성: AI가 생성한 콘텐츠는 부정확하거나 불완전하거나 특정 목적에 적합하지 않을 수 있습니다. 당사는 생성된 프롬프트가 다른 AI 시스템 사용 시 특정 결과를 달성할 것을 보증하지 않습니다. • 전문가 조언 아님: 서비스를 통해 생성된 어떠한 내용도 법률, 재무, 의료 또는 기타 전문적 조언을 구성하지 않습니다.
4. 책임 제한 및 면책/배상
• 책임 제한: 관련 법령이 허용하는 최대 범위 내에서, Promptivox 및 그 운영자는 서비스 이용이나 AI 생성 결과물에 대한 의존으로 인해 발생하는 데이터 손실, 비즈니스 중단을 포함한 간접적, 우발적, 특별, 또는 결과적 손해에 대해 책임을 지지 않습니다. • 면책 및 배상: 귀하는 귀하의 서비스 이용, 본 약관 위반 또는 제3자의 권리 침해로 인해 발생하는 모든 청구, 손해, 손실, 책임 및 비용(변호사 비용 포함)으로부터 Promptivox 및 그 운영자를 면책하고 보호하며 손해를 배상할 것에 동의합니다.
5. 금지 행위
귀하는 서비스를 다음 목적으로 사용하지 않을 것에 동의합니다: • 불법적이거나 유해하거나 위협적이거나 모욕적이거나 명예훼손적이거나 관련 법령을 위반하는 콘텐츠 생성 • 기반 AI 모델 또는 시스템 프롬프트의 리버스 엔지니어링, 스크래핑 또는 추출 시도 • 인프라에 부담을 주는 과도한 API 요청을 위한 자동화 스크립트 또는 봇 사용 • 타인이나 단체를 사칭하거나 관계를 허위로 표현하는 행위 • 서비스를 방해하거나 손상시키도록 설계된 바이러스, 악성 코드 또는 콘텐츠 업로드·전송 • 스팸, 피싱 콘텐츠 또는 기만적인 자료 생성 본 금지 사항 위반 시 서비스 접근이 즉시 종료될 수 있습니다.
6. 준거법
본 약관은 법률 충돌 조항에 관계없이 대한민국 법률에 따라 해석됩니다. 본 약관으로 인해 발생하는 분쟁은 서울 법원의 전속 관할에 따릅니다.
